OVERVIEW

Welcome to Trace the Living Word (“Trace the Living Word,” “we,” “us,” or “our”). We operate this website and store (the “Services”) to offer our products and related content. The Services are powered by Shopify.

By visiting or using the Services, you agree to these Terms of Service (“Terms”) and our Privacy Policy [LINK]. If you do not agree, do not use the Services.

1. ACCESS & ACCOUNTS

You represent that you are the age of majority in your jurisdiction and that any information you provide (e.g., email, billing, payment, shipping) is accurate and complete. You are responsible for safeguarding your account credentials and all activity under your account.

2. OUR PRODUCTS

We try to present products accurately, but colors/appearance can vary by device settings. Descriptions, availability, and pricing may change without notice. We may limit quantities or discontinue items at any time.

3. ORDERS & PRE-ORDERS

When you place an order, you make an offer to purchase; we may accept or decline at our discretion. We must receive and process payment before acceptance.

  • Pre-orders. If you purchase a pre-order item, your payment is charged at checkout. We’ll show an estimated ship window on the product page and notify you of any material changes. You may cancel a pre-order anytime before shipment for a full refund.

  • Your purchases are for personal/household use, not for resale.

  • Returns/exchanges are governed by our Refund Policy [LINK].

4. PRICES & BILLING

Prices, discounts, and promotions may change without notice. Unless stated otherwise, prices exclude taxes, shipping, handling, customs, and import duties. You agree to keep your payment and contact info current and authorize us (or our processor) to charge all amounts due.

5. SHIPPING & DELIVERY

Delivery times are estimates, not guarantees. We aren’t liable for delays caused by carriers, customs, or events outside our control. Title and risk of loss pass to you when we hand the order to the carrier. For international orders, the recipient is responsible for any duties, taxes, or import fees (non-refundable).

6. INTELLECTUAL PROPERTY

All content and materials on the Services (including trademarks, text, graphics, images, video, audio, and their arrangement) are owned by us or our licensors and are protected by law. You may use the Services for personal, non-commercial purposes only. No license is granted except as expressly set out in these Terms.

7. OPTIONAL TOOLS & THIRD-PARTY LINKS

We may provide access to third-party tools or link to third-party sites. These are provided “as is” without warranties. Use them at your own risk and review any third-party terms and policies.

8. RELATIONSHIP WITH SHOPIFY

Trace the Living Word is powered by Shopify. Sales in our store are made directly between you and Trace the Living Word. Shopify is not responsible for your purchases or any issues arising from them. You expressly release Shopify and its affiliates from claims related to your transactions with us.

9. PRIVACY

Your use of the Services is subject to our Privacy Policy [LINK]. Because Shopify hosts the Services, certain data is also processed by Shopify under its privacy policy.

10. FEEDBACK & REVIEWS

If you submit reviews, ideas, or other content (“Feedback”), you grant us a perpetual, worldwide, sublicensable, royalty-free license to use and display that Feedback for any lawful purpose. You represent you have the necessary rights and that your Feedback complies with these Terms.

11. ERRORS & CHANGES

We may correct errors or update information (including pricing and availability) at any time without notice, including after you submit an order.

12. PROHIBITED USES

You may not use the Services for any unlawful purpose, to infringe intellectual property or privacy rights, to transmit malware or spam, to scrape or harvest data, to circumvent security, or in any way that harms us, Shopify, or other users.

13. TERMINATION

We may suspend or terminate access to the Services at any time. Sections that by nature should survive (including IP, Feedback, Disclaimers, Liability Limits, Indemnification, Governing Law) survive termination.

14. DISCLAIMER OF WARRANTIES

Except as expressly stated by us in writing, the Services and all products are provided “as is” and “as available”without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. Your use is at your own risk.

15. LIMITATION OF LIABILITY

To the fullest extent permitted by law, Trace the Living Word and our officers, employees, agents, contractors, service providers, and licensors will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits/revenue/data, arising out of or related to your use of the Services or products.

16. INDEMNIFICATION

You agree to indemnify and hold harmless Trace the Living Word (and our affiliates, officers, directors, employees, and agents) from claims, damages, and expenses (including reasonable attorneys’ fees) arising from your breach of these Terms or violation of law or third-party rights.

17. SEVERABILITY

If any provision is found unenforceable, the remaining provisions remain in full force to the maximum extent permitted.

18. WAIVER & ENTIRE AGREEMENT

Our failure to enforce any provision is not a waiver. These Terms, plus policies referenced here (e.g., Privacy Policy, Refund Policy), are the entire agreement between you and us regarding the Services.

19. ASSIGNMENT

You may not assign or transfer these Terms without our prior written consent. We may assign or transfer them without notice.

20. GOVERNING LAW & VENUE

These Terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. You and Trace the Living Word submit to the exclusive jurisdiction of the state and federal courts located in Orange County, California, for any dispute not subject to applicable mandatory consumer law.

21. CHANGES TO THESE TERMS

We may update these Terms by posting a new version on the site and, where required by law, providing notice. Changes take effect on the date posted (or the date stated in the notice). Your continued use after changes means you accept the updated Terms.
